Police take my road tax!

Post by Gsi-Lomas »

Right we've all been stopped by the police at some point!

But

Has anyone had a police officer taken there road tax ( while road tax is in date)

What happened was my friend dropped me off, but i didnt have my phone, but my girlfriend said I left it at her house, so he was dropping her off, and picking up my phone.

while on route to her house the police seen him and to get to my girlfriends house you have to go up this dirt track, but the police thought he was trying to nick of from them, so they stopped him on her drive lol.

Asking who's car it is etc etc. and where he was going

while the police where quizzing him, they thought he stole my car, as he was giving them my details for it, not my brothers, I don't have a license, so my brother has insured it for me etc

They PnC checked the car and everything was clearer, taxed and insured etc they checked to see if my friend was covered and he is. which is fair enough.

The police officer was saying who's car is it etc again, and he didn't know my brothers names. but he got the disabled badges out the car, said look it's his car but it's in his brothers name has mr lomas doesn't have a driving license

While he was talking to 1 of the police officers the other 1 was checking the car over and come across my road tax (disabled) which this copper has now taken, went down the local police station explained what had happened etc and the woman on front desk & other police officer who she spoke to cant understand why this copper has taken my road tax! mad.gif

Which by this time a traffic copper said the car can still be used as it's taxed etc, so I kindly asked for his number etc if we get stopped and the police say where the road tax for this car. I've to give them his number.

I've to go back down to the police station at 8pm this is when the police office thats taken my tax is on duty!

The funny thing is, that non of the people that where talking to me, couldn't understand why he taken the road tax??

My friend did say 1 of the police officers was been ok, etc.. but you always have to get one that has to be a

* * * *, I noticed a sign on the police station window, (Respect) give respect - get respect. lol

Will post an update later on tonight, hoping I get my tax back!

Sigh!

OK, are you legally entitled to drive with disabled tax?
if not, maybe that is why.

I went down to the local police station, tonight and the officer who taken my tax disc has now sent it of to DVLA

I tried to explain to them, the reason for my mate driving my car, they thought my friend stole my car, so why the fudge didn't they contact me, and checkup?

The attitude for police officer to use, was damn right rude. it's not on, I know for a fact they wouldn't talk to a disabled person like that if he was in a wheelchair, etc. I'm disabled due to heart problem, shit happens

Anyhow the PC was PC Homerod that had taken my tax, and I've was told he's an asshole of a copper

Homerod did tell me he will get me done, for not having the car in my name, it's not agenst the law, as long as the car is taxed and insured with the registered keeper. it says on the logbook in small letters,

That the registered keeper in not nessory the owner of this vehicle

I can understand what my friend was talking about, that officers that stopped him where been right cocky gets, they where cocky towards me. In the end I ended up walking away saying I'll contact DVLA personally.

I got home, and I was fudgery pist off and thought I'm not having those 2 police officers talking to me as though I'm scum, I went down with my friend who also has disabled road tax, who is in his 50's. to see if he could find out why they taken the road tax etc.

We asked to see a police officer,( not the 2 I seen earlier ) and the lady on the desk went for another officer, which he turned out to be ok, and he could only explain half of it, and I should contact DVLA and explain what has happened etc He was reasonable, but the other 2 officers, need knocked down a peg or 2.

Also from what the police said, it's nothing to do with them now, it's between DVLA & me

I will contact DVLA and find out where I stand.

The tax has been sent of to DVLA.

I've Also sent a letter to DVLA, but I will be phoning them tomorrow first thing, as the police officers didn't give me a chance to explain why my friend was using my car, and they didn't give my friend the chance to explain either, and if they suspected the car was stolen then they should of contact headquarters to see if that car as been reported stolen, or the the police had a brain between them, they should of contacted me or my brother. ( which they didn't)

The reason they took the road tax out of my car is that my friend couldn't give a good enough reason why he was in my car. but when I went to the police station in the morning, the lady on the front counter spoke to another traffic officer who was been helpful, and he couldn't understand why he taken my road tax, the office did give me his badge number and if the police stop car and see there is no road tax, he will explain the situation to them.

I will update when I've been in touch with dvla.

you will probably get charged for a duplicate by the dvla just to piss you off even more.

I would advise you not to use the car as pc"plod" may happen to stop you again noticing no disc on the window
and end up with a fine for "not displaying a valid tax disc" irrelevent of what proof you have
and also when parking wardens have the power to report an untaxed vehicle ...be carefull !!

Its that typical bureaucratic system that does't listen and your the one suffering for their F** ups.

Hope you sort it out keep us posted

Hello all,

I've been in contact with DVLA and the woman who I spoke, didn't seem that concerned about the matter,
she did say that she can't speak for the police is actions,

I explained the reasons and what the 3 police officers I spoken too, and she said well if they have said that you can still use the car then thats ok. if they didn't you could get a duplicate tax etc. I will have to travel 32miles and pay a fee to get this tax, ( I get mine for free) and I had a valid tax disc in my car, until P.C chuff had taken it out of my car.

I will phone DVLA again next week as this will have given time for my tax to get to them and also my letter. due to the post been on strike!

I don't know your personal circumstances, but what im reading in your thread here does not add up at all!!

1. West Mercial Police removing a Valid Road Licence from a vehicle.

* Does said car have a vaild MOT certificate?
* Are there any defects on said vehicle?
* Was the driver of the car speeding, or committing an offence prior to being stopped.?

2. West Mercia Police telling you to drive a vehicle without displaying a valid Tax Disc.

* It's an offence to do this. Do not drive this vehicle without displaying said Tax. You will receive a fine.

3. Have you any motoring convictions? (I know you don't have a licence).

* If you have been stopped for driving without insurance in the past, this maybe the reason for tug in the first place, but does not explain why the Police would remove a Valid Tax disc, unless said disc was either from another vehicle, or printed via a computer printer(fraud).

My Cavalier taxations class as disabled on the log book,( I'm disabled)

I was not in the car, when the event had taken place,I went home as I get badly now and then,

The police stopped my driver, who was taking my girlfriend home, and picking up some personal belongings,
on the way there the police seen my car, and decided to stop the car and do a random PnC check, they've got to stop someone. They PnC checked the car and everything was OK. car is taxed, m.o.t, and insured.

When they approached my friend, asking who's car is this, my friend told them the truth, saying it was my car, although the car is mine, but it's in my brothers name and on my brother insurance policy this is legal

See logbook - registered keep is not necessarily the legal owner

Anyhow, as my friend couldn't give the right details of who the car belong to, has he don't know my brother very well, the police started accusing him of stealing the car. and was going to arrest him, the police did a PnC check of my friend to make sure he was insured to drive the car, and everything come back OK.. but when the police checked the car over, ( searching my car) which I can't understand why? cheeky gets!

They come across my disabled road tax, (valid) and told my friend that he is driving my car with no road tax. and the police didn't give my friend a chance to explain, they took the tax and said, tell your friend to get the car in his name and DVLA will be contacting him. Then off they go!

I went down the police station next morning with my friend, and neighbor who is also disabled, trying to find out why they took my road tax. Non of the people who I spoke to couldn't understand either, I was told to come back at 8pm when the officers that took my tax will be on duty, in the mean time I asked if it will be ok to still use the car, and they said yes.I asked for this in writing, woman on the desk said she couldn't. so I told her to go and find out for me off a officer, so off she goes, comes back 2min later, yes you can still use the car, a police officer as given me his badge number for you, if you get stopped give the officer that stops you his badge number, he'll sort it from there, this officer been a Traffic cop.

I went back to the police station at 8pm, just me and my friend, and the 2 police officers that stopped my car where outside, so I went out, asked where is my road tax, it's been sent of to dval, I asked why? your friend couldn't give us a reason why he was using your car, I said well you were accusing him of stealing the car, WHY didn't you get in contact with me, I would of sorted the matter out. As I tried to explain to the officer, by this time the other officer jumped out of his car giving my a gob full, - do you want done, he says, I say on what grounds, for not having that car in your name. I laughed and said read the small print on the logbook! and after this it turned into a slagging match, so I walked away saying I'll speak directly to DVLA. Then me and my friend went.

I went to my neighbors house (who's also disabled and my friend) and asked him to come down to the police station he's over 50ish so police shouldn't be snooty with him. Anyhow we asked to see an officer who could explain why my road tax was taken, but not the 2 officers I spoken to, so she went up stairs and came back with another officer, so him and my friend got chatting, and this copper didn't really have the answers to what my friends questions, and kept saying well thats a gray area, thats to do with dvla. He did say, well the car does have disabled road tax, and that should really be used for your benefit, I replied yes, and he was dropping my girlfriend off and pick up my personal belongings. but the police didn't give my friend chance to explain.
My friend also said, anyone can use the car, as long as they are using it for the disabled persons benefit, my friend has this in writing, but couldn't find the paper work, (typical)

I was told to place a notice in window in case I get a fine for no tax, although the car is taxed and if I do get any tickets they'll be void, I have contacted DVLA and I've also sent them a letter, I will be contacting DVLA next week as well, if they don't already contact me.

Anyone can drive my car, ie if there insurance covers them to, and as long as they are using the car for my benefit, as this was what my friend explained to the officer.

The police were been totally dick heads, they where been dicks with me, but If I went down in a wheelchair, it will be totally a different story. It's my heart thats why I'm disabled, been in hospital more times than soft mick, I was born with a dodgey ticker.. Can't all be perfect!
